ABS-CBN releases statement on court decision dismissing case vs AGB Nielsen
Here is the statement of ABS-CBN on the dismissal of its case by the court against AGB Nielsen Media Research Philippines.
The public will not be denied the truth because of a mere technicality. ABS CBN will continue its fight and file a motion for reconsideration. Our case and our moral purpose can only get stronger, as more and more witnesses are coming out to tell the truth about cheating in the ratings.
The fight for a clean and fair TV ratings process is a crusade that ABS-CBN will continue. Our witnesses’ courage and passion for truth inspire us and fortify our will to fight for a clean and fair TV ratings process. We promise to continue telling their stories so the public will know how ratings are being manipulated.
Cheating is not data error and can never be considered as such. Bribing households equipped with TV meters to change their members’ viewing behavior should be condemned. Acknowledging that it exists and refusing to clean the process is tantamount to condoning and allowing cheating to happen.
Our issue is simple. We want AGB Nielsen to clean up their panels and replace the corrupted ones. The process is difficult, but it is the only way that AGB Nielsen can demonstrate its sincerity, intention, and determination to have a clean and fair TV ratings data for the media industry and the viewing public.
We ask the media industry to join our crusade for clean and fair TV ratings process. We trust that in due time, we will be allowed to present our evidence to enable the court to determine who is telling the truth.

The Quezon City Regional Trial Court (QCRTC) on Monday junked the P63-million damage and breach of contract complaint filed by ABS-CBN Broadcasting Corporation against survey firm AGB Nielsen after the case was found to have been “prematurely filed.”
In a seven-page order, Charito Gonzales, QCRTC Branch 80 presiding judge, junked ABS-CBN’s petition by granting the motion to dismiss filed by AGB Nielsen Media Research (Philippines) Inc.
“For failure of ABS-CBN to comply with the condition precedent to the filing of the instant complaint, this Court has to regrettably, dismiss the instant case for being prematurely filed,” Gonzales’s order said.
“ABS-CBN’s resort to court is premature. Yielding to ABS-CBN’s contention will violate the principle of mutuality of contracts ordained in Article 1308 of the Civil Code, for Article 1196 of the same law states ‘Whether in an obligation a period is designated, it is presumed to have been established for its benefit of both creditor and debtor,’” the order added.
In its motion to dismiss, AGB Nielsen argued that the case against it should be dismissed because ABS-CBN failed to comply with an earlier agreement with the survey firm.
AGB Nielsen said that ABS-CBN failed to comply with the provisions of Section 5 of the Service Contract for TV Audience Measurement Mega Manila and National Urban Service.
The provision stated that AGB Nielsen has a month to answer questions, issues or concerns regarding data quality and validity.
The same agreement also provided that parties shall have a period of three months from AGB’s explanation to discuss the questions in good faith, with full confidentiality, with neither party resorting to disclosure of the matter to the public or media.
AGB Nielsen added that ABS-CBN failed to implead an indispensable party, which is necessary to the suit.
In her order, Gonzales ruled that GMA Network was not an indispensable party in the case because the latter was not a party to the contract, hence it is not necessary to implead it.
“Plaintiff can be afforded complete relief without the presence of GMA and its claim against defendant can be determined without GMA being impleaded as a party. Moreover, this court can make a final determination as to whether or not there was breach even without GMA being a party to the action,” Gonzales’s order said.
In a related development, another Quezon City court summoned ABS-CBN and 15 of its personnel to answer a P15-million damage suit filed by GMA Network.
Judge Samuel Gaerlan, QCRTC Branch 92 presiding judge, issued the summons directing ABS-CBN to answer within 15 days.
The summons was set to be served Monday.
GMA Network through its legal counsel, Gener Asuncion, filed the damage suit on January 3, over ABS-CBN’s allegations that GMA was behind the alleged rigging and manipulation of TV ratings in Bacolod City.
Aside from ABS-CBN, also named defendants were dzMM station manager Angelo Palmones; dzMM news manager Alona Magsalas; dzMM reporter Junrie Hidalgo; “Showbiz Mismo” hosts Jobert Sucaldito and Cristy Fermin; news program Bandila production head Luchi Cruz Valdez and Bandila executive producer Boyet Agustin.
Other defendants were ABS-CBN Legal Department head, lawyer Maximillan Uy; Bandila anchor Korina Sanchez; Entertainment Live and The Buzz production heads Malou Santos and Luis Andrada; Entertainment Live executive producer Lani Gutierrez; The Buzz and Entertainment Live headwriter Romel Gonzales; The Buzz executive producer Nancy Yabut and The Buzz head writer Ian Reyno.
GMA asked the court to order ABS-CBN to pay P10 million for moral damages; P2.5-million for exemplary damages; P1.5-million for attorney’s fees and P1-million for litigation expenses.

Marimar welcomed the Year of the Rat with a decent 38.8 percent rating last January 1. The rating of the Marian Rivera telenovela improved the following day, January 2, with 39.4 percent clip.
Richard Gutierrez’s Kamandag and the metal series Zaido were also consistent in their No. 2 and No. 3 positions, respectively. Kamandag posted a rating of 36.3 percent on Jan. 1 and 38 percent on Jan. 2. Zaido, on the other hand, got 30.5 percent last Tuesday and 34 percent last Wednesday.
The suspense-thriller series La Vendetta took the No. 4 spot last Tuesday with 28.2 percent, but 24 Oras grabbed that same spot last Wednesday with 31.8 percent.
Meanwhile, Lastikman was the highest-rated ABS-CBN primetime show on Jan. 1 and 2, with TV Patrol World a close second.
GMA-7’s new Koreanovela, Coffee Prince, premiered on New Year’s Day with an impressive 20.7 percent rating, good for No. 8 position. Although its rating improved the following day, 21.9 percent, it slipped to No. 9 behind Pinoy Big Brother Celebrity Edition’s 22.9 percent.
Meanwhile, the daytime race is a bit unpredictable as Kapamilya, Deal or No Deal took the No. 1 spot on Jan. 1 with 17.4 percent. But Daisy Siete regained the top spot the following day with 21.4 percent.

Trial by publicity lang lahat at ayan nagbackfire sa kanila. Kung talagang talo talo. Pagbutihin na lang ang show at nang makabawi. Baka in the near future ABS na naman uli ang number one. Ganyan talaga ang buhay minsan nasa itaas. Tumigil na sana sila yung ngang sa wowowee tahimik lang ang ABS kung talagang gusto nila ng truth unahin na ang sariling bakod hindi yung iba nakikita yung sa kanila hindi.

- Cheating is bad. But acknowledging something THAT MAY NOT EXIST OR HAS NOT BEEN PROVEN (in this case) to tarnish the credibility of others is not right. ABS needs to accept that they’re losing the ratings game.

Affidavits submitted by AGB Nielsen general manager Maya Reforma revealed that 79 among 532 AGB Nielsen metered homes in six cities were exposed to “activities” of GMA Network.
Reforma said the 79 panel homes were persuaded to watch GMA shows in exchange for monthly prizes including P500 in cash, groceries, umbrellas, pens and medicine. “Panel homes who declare themselves to be watching ABS-CBN are asked to become a member of the GMA Kapuso viewers in order to receive a monthly supply of groceries and P500,” she said, describing one of the activities.
She added that of the 79 homes, 63 homes were visited once while 16 were visited twice or more times.
She said statistical tests conducted by AGB Nielsen showed that 16 of the 79 homes “showed a significant change to favor GMA in its viewing behavior.”
She noted, however, that the evidence obtained by AGB Nielsen “strongly indicates that the tampering was confined to Bacolod and for the period from July to September 2007.”
Reforma told the court that AGB Nielsen has replaced the 79 tampered homes from its television audience measurement panel. “We are also considering removing Iloilo as a sampling point,” she added.

Yong ratings game din yon, kung sino makakakuha ng maraming advertisers. Inggit kasi ang ebs kasi 20% ang net returns ng mga investors ng gma7, e sila kung di pa daanin sa pagtataas ng presyo ng kuryente. Masakit sa mga lupis na matapos nilang i-give up ang tubig e biglang kambyo ang piso, biglang baba ang dolyar, nagkamali na naman ng forecast yung kanilang economist. palpak sa analysis. Ratings controversy
On December 20, 2007, Judge Charito Gonzales, Quezon City Regional Trial Court Branch 80 released a temporary restraining order on TV ratings surveys based on a civil case filed by ABS-CBN Broadcasting Corporation versus AGB Nielsen Media Research Philippines. ABS-CBN accused “a certain television network” of funding bribing operations at Bacolod to discredit the former. The Court further ordered ABS-CBN Broadcasting Corporation to file comment on the plea of AGB Nielsen for the alleged gathering and dissemination of television ratings data, within 5 days or until December 22. ABS-CBN filed a case to cite AGB Nielsen for contempt after it released TV ratings data despite the issuance of the TRO.
On December 21, DZMM correspondent Junrie Hidalgo reported a news story entitled AGB Nielsen, umamin sa dayaan: GMA Network, tahasang itinurong nasa likod ng dayaan (AGB Nielsen admits the cheating: GMA Network fiercely accused of being responsible of the cheating) during the program Teledyaryo, hosted by Cristy Fermin and Jobert Sucaldito. The news story is based on an interview of AGB Nielsen’s General Manager Maya Reforma regarding the alleged cheating.
In response, GMA aired a TV plug condemning the alleged biased reporting and denied the accusations of ABS-CBN. They later filed a PHP15-million civil libel suit against ABS-CBN on January 3, 2008. The respondents included Hidalgo, Fermin, Sucaldito, the station manager and news manager of DZMM and hosts, writers and executive producers of TV programs Bandila, Entertainment Live and The Buzz after the same story was aired on the mentioned programs.
On January 7, the Quezon City RTC junked ABS-CBN’s suit against AGB Nielsen, saying the case was “prematurely filed” before the court.

Hindi ba kayo nagtataka kung bakit kahit maganda ang show sa abs e bagsak pa rin ng rating, na consistent bottom ang abs sa primetime. i think ok lang na may mababa sa abs but not all kasi may magandang shows din naman ang abs, at may pangit ding shows ang gma, however the ratings always favor GMA shows.

MANILA, Philippines — Former executives, managers, anchors, reporters, writers, editors, crew and production staff of the old newsroom of the Lopez-owned ABS-CBN gathered Thursday for a night of fun and reminiscing at the Forest Grill on Timog Avenue, Quezon City, just a stone’s throw away from the offices of rival network GMA 7.
She added that the old newsroom was a real family that genuinely cared for each other.
There was no backbiting, no crab mentality, no pretensions, she said. “Our priority then was not to get to the top but to be the first to give the news.”
It’s not about ratings
“Sorry to say, pero kapag nanood ka ng news ngayon, nagpapabonggahan lang at alam ng manonood iyon. Hindi tulad noon na nauuna kasi may linya, may kuneksiyon, hindi dahil sa may paunang usapan na (When you watch the news today, the networks are just trying to outdo each other and the audience knows this. In the past, when you were first with the news it was because you worked hard, you had good contacts, not because there was a prior agreement).”

Let’s look at he facts:
somebody came to ABS-CBN, and said that the ratings have been tampered.
ABS-CBN informed AGB about it.
AGB made their own investigation.
AGB confirmed of the 79 home that were contacted allegedly by GMA in Bacolod.
AGB then cofirmed that ratings were tampered in Bacolod.
ABS-CBN expressed that if ratings were tampered in Bacolod, this couldve been done the same throughout the country.
ABS-CBN wants to know the truth!

1. “Instead of being accurate in its reporting, the ABS-CBN abused its clout as a broadcaster to engage in an intense media campaign to publicly vilify the petitioner (AGB Nielsen) and gain public sympathy for its cause, evidently to advance its private interest as litigant,” AGB Nielsen said.
2. AGB Nielsen argued that ABS-CBN’s graphics that were aired in some of its shows omitted the key qualifying phrase “from corrupted home panels,” making it appear that the research firm’s data-gathering and data-delivery services were totally stopped.
3. “The insertion of an ellipsis (…) in place of the qualifying phrase in respondent’s graphics misrepresents the contents and the import of the court order. Respondent (ABS-CBN) is not ignorant of the meaning of the qualifying phrase considering that it is found in paragraph 4.4 and the prayer of its own complaint,” AGB Nielsen said, referring to the broadcast company’s P63-million damage suit
4. AGB Nielsen further stressed that aside from misinterpreting the court order, ABS-CBN also accused the research firm of having violated the terms of Judge Gonzales’ order. The said accusations were aired at news program Bandila and show biz talk show, The BUZZ on December 21 and 23, 2007, respectively.

The fight for a clean and fair TV ratings process is a crusade that ABS-CBN will continue. Our witnesses’ courage and passion for truth inspire us and fortify our will to fight for a clean and fair TV ratings process. We promise to continue telling their stories so the public will know how ratings are being manipulated.
Cheating is not data error and can never be considered as such. Bribing households equipped with TV meters to change their members’ viewing behavior should be condemned. Acknowledging that it exists and refusing to clean the process is tantamount to condoning and allowing cheating to happen.
Our issue is simple. We want AGB Nielsen to clean up their panels and replace the corrupted ones. The process is difficult, but it is the only way that AGB Nielsen can demonstrate its sincerity, intention, and determination to have a clean and fair TV ratings data for the media industry and the viewing public.
We ask the media industry to join our crusade for clean and fair TV ratings process. We trust that in due time, we will be allowed to present our evidence to enable the court to determine who is telling the truth.

“Instead of being accurate in its reporting, the ABS-CBN abused its clout as a broadcaster to engage in an intense media campaign to publicly vilify the petitioner (AGB Nielsen) and gain public sympathy for its cause, evidently to advance its private interest as litigant,” pahayag ng AGB Nielsen.
Iginiit ng AGB Nielsen na sa ilang graphics ng ABS-CBN na ipinakita sa iba’t-iba nitong programa, tinanggal ang bahagi sa utos ng korte kung saan ipinatatanggal lamang sa kanilang survey ang mga “corrupted home panels” at hindi ang kabuuan nilang “data-gathering and data-delivery services.”
Tinukoy ng AGB na lumabas ang naturang graphics sa programa ng ABS-CBN na Bandila noong Disyembre 20 at Umagang Kay Ganda noong Dis. 21.
Kinuha ng AGB ang impormasyon mula sa utos ni QCRTC Branch 80 Judge Charito Gonzales noong Dis. 20 na kinatigan ang temporary restraining order na hinihiling ng ABS-CBN.
“The insertion of an ellipsis (…) in place of the qualifying phrase in respondent’s graphics misrepresents the contents and the import of the court order. Respondent (ABS-CBN) is not ignorant of the meaning of the qualifying phrase considering that it is found in paragraph 4.4 and the prayer of its own complaint,” giit ng AGB Nielsen tungkol sa P63-million damage suit ng ABS-CBN.
Ayon pa sa AGB Nielsen, na bukod sa maling interpretasyon sa utos ng korte, inakusahan din ng ABS-CBN ang kumpanya ng paglabag sa utos ni Judge Gonzales. Ang mga naturang akusasyon ay ipinasahimpapawid pa ng ABS sa mga programang Bandila (Dis. 21) at the Buzz (Dis. 23) noong nakaraang taon.
Nanindigan ang AGB na hindi nila nilabag ang kundisyon ng korte sapagkat itinigil na nila ang pagkuha ng datos mula sa mga corrupted home panel at hindi rin sila naglabas ng datos mula sa mga nasabing kabahayan.
Nakasaad sa petisyon ng AGB Nielsen na may karapatan sila sa patas na paglilitis sa korte na hindi naiimpluwensiyahan ng publiko.
Sinabi ng AGB na hindi lamang lumabag sa sub judice rule ang ABS-CBN kundi inilagay din sa alanganin ang integridad ng judicial proceeding sa Branch 80 ng QCRTC.
“Respect for due process and the orderly administration of justice, the petitioner prayed that the respondent be declared in contempt and punished accordingly,” ayon sa AGB. -

Abs-Cbn ang tunay na no.1 sa aming mga puso at hindi ang Gma. Sana lumabas na ang katotohanan sa pandaraya ng Gma, kawawa kmi dito sa Silay, madami-dami din kaming binabayaran dito. Ang tatay ko kasi kinakausap nila kaya ayun, pinagbabawala kaming maglipat ng channel. Wag niyo lang po isama sa ikukulong ang mga bahay na sinusuhulan kundi ang nagpasuhol lng po ha? Wala nman kmi kasalanan kundi lang siguro nangangailangan ang papa ko eh di naman namin tatanggapin ang pera, d ko alam magkano at tatlong bag ng mga pagkain at shampoo,colgate at corned beef at beef loaf. Sana matigil na, kahit wala na yang biniigay nila, ok lang para matuto nmang magtrabaho si tatay, puro nlang kami umaasa sa binibiga nila, yung iba expired pa. D tuloy ako mkapanuod ng barbara. Sana wala nang problema ang Pilipinas.

you know what guys, its not the ABS-CBN who made issue become bigger… it’s the GMA-NETWORK.. why because ABS-CBN have their own witnesses that made their allegation right… if GMA was right about to what they say,then why not na ipa-face nila sa court yong mga witnesses din nila…. for those people who says na mandaraya ang ABS-CBN pwes they’re wrong!!!! ingit lang kaU.. mga talents nga ng GMA nagsisilipatan na sa ABS eh, mga ala clang kwenta!!
